Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FreshBasky mobile application and website (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create a FreshBasky account and place orders.

2. Orders & Availability

Product availability, pricing, and delivery times shown in the app are estimates and may change without notice. FreshBasky reserves the right to refuse or cancel any order, including in cases of pricing errors, stock unavailability, or suspected fraud.

3. Payments

You agree to pay all charges incurred through your account at the prices in effect when the order is placed, including applicable delivery fees and taxes. Online payments are processed by third-party, PCI-compliant payment providers.

4. Delivery

Delivery times are estimates and not guaranteed. FreshBasky is not liable for delays caused by circumstances outside our reasonable control, including weather, traffic, or third-party delivery partner availability.

5. Cancellations & Refunds

Orders may be canceled prior to preparation as described in the app. Refunds for damaged, missing, or incorrect items are handled through the in-app Help Center on a case-by-case basis.

6. User Conduct

You agree not to misuse the Service, including attempting unauthorized access, submitting fraudulent orders, or interfering with the operation of the app.

7. Limitation of Liability

To the maximum extent permitted by law, FreshBasky shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

8. Termination

We may suspend or terminate your account at our discretion if these Terms are violated or fraudulent activity is suspected.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which FreshBasky, Inc. is incorporated, without regard to conflict-of-law principles.

10. Changes to Terms

We may revise these Terms periodically. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
